Terms of use

The Portuguese version is the reference text. If the versions diverge or contradict each other, the Portuguese one prevails. If the version you read when you entered into the contract says anything more favorable to you, that is the one that applies to your contract (art. 47 of the CDC, the Brazilian consumer protection code). Read the Portuguese version

These terms apply between you and the company that runs oculos.io. Read them before subscribing or sending a request through the site.

They are written to be understood. If any sentence here is unclear, write to [email protected] and we will answer in writing.

1. Who you are contracting with

oculos.io is run by Colabtec Digital LTDA, company number CNPJ 65.787.255/0001-91, Alameda Rio Negro, 503, sala 2020, Alphaville, Barueri, SP, CEP 06454-000, Brazil. It is the company that sells the subscription, charges you, issues the invoice and is legally responsible to you, in every country.

Zhuhai Colabtec Technology Co., Ltd., in Zhuhai, Guangdong, China, belongs to the same group and runs the lab where the devices are tested. It is the company that handles the import requests, the development requests and the lab test requests sent through the site.

Using a company in China to carry out part of the work does not shift that responsibility. Colabtec Digital LTDA is the party liable to you (art. 14 of the CDC, the Brazilian consumer protection code).

2. Who can subscribe, and your account

To subscribe you have to be 18 or older and legally able to enter into a contract. The site is not meant for minors.

You create the account with an email address and a password, or by signing in with a Google or Microsoft account. The details you give have to be yours and have to be correct.

The password is personal, and you are responsible for the use of your account. If someone else gains access to your account through no fault of yours, you are not responsible for that, as long as you change the password and tell us through the contact channel as soon as you notice.

The account is individual. One subscription serves one person.

3. What the subscription gives you

The subscription gives you access to the smart glasses development material published in the member area.

Material is published over time. You get access to whatever is online while the subscription is valid, and not to a closed list defined on the day you signed up.

What is included:

  • test APKs;
  • code repositories published for members;
  • technical documents, PDFs and device spec sheets;
  • review and test videos made by the team;
  • the right to ask for a test on a real device in the Zhuhai lab.

4. What the subscription does not give you

It is worth saying what stays out, so you can decide before paying.

  • Devices. oculos.io does not sell glasses, has no cart and holds no stock.
  • Consulting, code review or one-to-one development support.
  • Compatibility with every device, firmware or system version, and the support to get there. Test builds are study material, delivered as is: that describes what the subscription includes, and it does not set aside the legal warranty the Brazilian consumer protection code gives you over the subscription service itself.
  • A set date or a promised result for a lab test request. What the subscription includes is the right to ask, and section 6 explains how a request is assessed.
  • Quotes, importing, freight, taxes or regulatory approval for any device.

5. How you pay, and how you cancel

There is a single plan, billed monthly. There is no annual plan, no usage quota and no minute counter.

On the Portuguese version of the site the charge is in Brazilian reais. In the other languages the charge is in US dollars. The currency and the amount appear on screen before you confirm.

The currency follows the language you are using the site in, not the country you pay from. If you are in Brazil and use the site in English, Spanish or Chinese, the charge is in US dollars and Pix is not offered: Pix exists only on the Portuguese version. To pay in Brazilian reais, switch the site to Portuguese before you subscribe.

Card charges are processed by Stripe, and the card number never passes through oculos.io. In China the available method is an international card, because the site accepts neither Alipay nor WeChat Pay.

Access paid by Pix, the Brazilian instant payment system, lasts 30 calendar days from the moment the payment clears. It does not renew on its own. To continue, you pay a new Pix, and the new period starts when the current one ends.

On card, you cancel from the account area, at any time and with no penalty. Access continues until the end of the period already paid for, and the next charge does not happen. With Pix there is nothing to cancel: access ends on its own.

Refunds of money already paid follow the refund policy, which is part of these terms.

The subscription price is final and carries no fee of ours. When the charge is in US dollars, your bank may add currency exchange tax, a conversion spread and fees of its own: those amounts belong to your bank, never reach us and are not part of a refund.

There are three ways to pay:

  • card in US dollars, USD 99 per month, renewing automatically;
  • card in Brazilian reais, R$ 549 per month, renewing automatically;
  • a single Pix payment of R$ 549, which gives 30 days of access and does not renew. Pix is available to those paying from Brazil, on the Portuguese version of the site.

6. Asking for a test on a real device

Subscribers can ask the team to test something on a real device in the Zhuhai lab, for example whether a feature works on a specific model.

A request is only a request. The team decides whether it can run it, with which device and when. There is no guarantee that it will be carried out, no guaranteed date, no guaranteed result and no guarantee that the device you asked about is available.

When a test does happen, the result is technical information about that device and that system version. It does not count as an expert report, a certification or a regulatory approval.

7. How you may use the material

While the subscription is active, you hold a personal, non-transferable and non-exclusive license to use the material in developing your own applications and projects.

The license is yours. It does not pass to your company, to a client of yours or to another person on your team. Everyone who needs the material needs a subscription of their own.

The APKs and the repositories are test builds, and you are told so before you subscribe: they are delivered as is and may not work on another device, another firmware or another system version. You install them at your own risk. That describes what the material is, and it does not set aside the legal warranty that the service has to be fit for purpose (CDC art. 24).

Installing an application outside the official store can go against the device maker's terms and can affect its warranty. That decision is yours.

oculos.io does not provide root access, does not provide firmware images for flashing and does not provide modified OTA updates, and it does not tell anyone to do any of that.

When the subscription ends, the right to download new material ends with it. What you have already built stays yours.

Within this license, three things are not allowed:

  • redistributing or reselling the material, in whole or in part;
  • publishing the raw material from the member area anywhere else;
  • sharing the account, the password or the download links.

8. How the material reaches you

Each file is delivered through a signed, individual link that is valid for 10 minutes. The link is generated for your session and stops working after that.

Each download is recorded in your account, with the date, the material, and a value derived from your IP address and your browser. The record exists to protect the licensed material and to look into account misuse.

Passing a signed link to someone else is sharing the account, and section 11 covers that.

9. Import and development requests

The site has two forms: one to import glasses made in China and one to order the development of an application.

What the site does is take the request and pass it to the team. It closes no deal, generates no charge and creates no obligation to supply.

The answer comes by email, with a proposal, a scope of work and a timeline. If there is an agreement, the contract is signed separately, and that contract governs the work.

The purchase contract or the development contract is signed with Colabtec Digital LTDA, which is responsible for it. Zhuhai Colabtec carries out the technical part on Colabtec Digital LTDA's instructions.

Quotes, purchase contracts, freight, cargo insurance, taxes, customs clearance and approval by Anatel, the Brazilian telecom regulator, stay outside the site and are handled case by case.

oculos.io does not sell devices through the site. There is no cart, no device purchase price and no stock.

10. What the site publishes about devices

Reviews are the team's opinion. They are written from third-party reviews, from official manufacturer spec sheets and, where it exists, from measurement done in the Zhuhai lab.

Every number published carries its source and the label saying where it came from: measured in our lab, according to the manufacturer, community reports or press coverage. A label is never promoted to a stronger one.

Device prices, availability and specifications change without notice. The site guarantees none of them, and what counts at the moment of buying is what the manufacturer or the seller states.

Trademarks, product names and official images belong to their owners. oculos.io is not affiliated with any manufacturer mentioned, is not an authorized reseller and does not represent any of them.

Product images that have been digitally treated keep the real appearance of the device, and the caption says where the image came from.

11. Acceptable use

By using oculos.io, you agree not to do the following:

  • share the account, the password or the download links with another person;
  • redistribute, resell or publish the material from the member area;
  • scrape the site, copy the catalog in bulk or use a robot to download content;
  • try to get around the access control, the captcha or the expiry of the signed links;
  • send a false request through the forms, or another person's details without their knowledge;
  • use the site for fraud, harassment, illegal activity or infringement of someone else's rights.

12. Suspension and closing an account

You can close your account from the account area, at any time.

We can suspend or close an account that breaches section 11, with notice when that is possible, and without notice when the use puts the material or the running of the site at risk.

If a suspension turns out to have been unjustified, access comes back and the days you lost are added to the end of your paid period.

If an account is closed for a breach, the part of the paid period you did not use is refunded, with only the loss the breach caused deducted, shown to you in writing. Section 7 of the refund policy explains it.

If the whole service is shut down, we tell you by email at least 30 days in advance and refund, pro rata, the part of the period you paid for and did not use.

Download what you need before closing the account. Once access ends, the signed links stop working.

13. Liability

Colabtec Digital LTDA is liable to you under the Brazilian consumer protection code. Bringing in Zhuhai Colabtec to carry out part of the work does not remove that liability.

There is no liability cap, no mandatory arbitration and no clause that limits, waives or restricts any right you have (CDC art. 51).

We are liable for what we sell: keeping the site online, delivering the material we announce and handling your data the way the privacy policy says.

We are not liable for what the maker of your device or the shop where you bought it does or fails to do. With import and development requests, the site only takes the request: deadlines, delivery, transport and regulatory approval sit in the contract signed separately, and that contract says who answers for each of them.

We are also not liable for network failures, power cuts or internet access blocked outside our control.

14. Your 7-day right to cancel

You have 7 calendar days to withdraw from the subscription and get a full refund, with no need to give a reason. The period counts from the first card payment and, with Pix, from each payment, because each Pix is a new purchase. This is the right of withdrawal in art. 49 of the CDC, and it applies because the purchase is made over the internet.

The 7-day rule is the same for someone paying from Brazil and for someone paying from any other country. If the law of the country you are in gives you a longer period or an additional right, that law applies, and Colabtec Digital LTDA complies with it.

The refund goes out immediately, as art. 49 requires. The refund policy explains how to ask, how the money comes back and how long it takes. It is part of these terms.

15. Changes to these terms

A change to these terms takes effect for you at your next renewal, or at your next Pix. For a period already paid for, the text that was online when you entered into the contract is the one that applies.

A change to the price, to what the subscription delivers or to your rights is announced by email at least 30 days in advance, and you can cancel before it takes effect. The refund policy still applies to what has already been paid.

The version and the date sit in the footer of this page, so you can tell which text was online on a given date.

16. Law, jurisdiction and language

Brazilian law applies.

The courts of Barueri, SP, Brazil, are the agreed venue, without prejudice to the consumer's right to bring proceedings in the courts of their own place of domicile (CDC art. 101, I).

This document exists in Portuguese, English, Spanish and Chinese. The Portuguese version is the reference text, and it prevails if the versions diverge or contradict each other.

If the version you read when you entered into the contract says anything more favorable to you, that is the one that applies to your contract: a translation never takes away a right the Portuguese text gives you (CDC art. 47).
